Terms of Service

1. Eligibility

You must be at least 18 years of age and legally able to enter into a binding contract. If you list a property, you represent and warrant that you have the legal right to sublet it under your existing lease, governing condominium documents, HOA rules, and applicable law. SublettingU is not responsible for verifying the lawfulness of any individual sublet.

2. Account Requirements

• — You must provide accurate, complete, and current information when creating your account, and keep that information up to date.
• — Each person may register only one account. Operating multiple accounts to manipulate ratings, reviews, or pricing is prohibited.
• — You are responsible for all activity under your account and for keeping your login credentials secure.
• — You may not impersonate another person, share your account, or transfer it to anyone else.

3. Identity Verification

All users must complete identity verification before booking or listing a property. You agree to provide a valid government-issued ID and a verification selfie. Failure to verify, providing false documents, or any attempt to bypass verification is grounds for immediate account termination.

4. Property Verification

Listers must submit proof that they have the right to sublet — typically a current lease, utility bill, or other official document showing their name and the listed address. SublettingU reviews each submission and reserves the right to approve, reject, or remove a listing at any time.

5. Listing Requirements

• — All listing information must be accurate, including address, dates, price, and amenities.
• — Photos must be of the actual property. Stock photography, AI-generated images, or photos of other units are prohibited.
• — A minimum of 5 real photos is required.
• — You must clearly state whether the unit is furnished, and disclose all rules regarding pets, smoking, guests, and parties.
• — Move-in and move-out dates must be specified accurately.
• — Proof of right to sublet must be uploaded before the listing goes live.

6. Prohibited Content and Conduct

You agree not to:

• — Post listings or content that is fraudulent, misleading, or illegal.
• — Discriminate against any user on the basis of race, color, religion, national origin, sex, sexual orientation, gender identity, disability, familial status, or any other protected class.
• — Harass, threaten, or stalk other users.
• — Use the platform to launder money, evade taxes, or commit any other crime.
• — Scrape the site, attempt to interfere with our infrastructure, or reverse-engineer the service.
• — Use the platform for any short-term hospitality offering that violates local short-term rental laws.

7. Content License and Marketing Consent

When you submit content to SublettingU — including listing photos, descriptions, property details, and any other materials you upload (collectively, “Your Content”) — you keep ownership of it. You grant SublettingU a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, reformat, display, and distribute Your Content for two purposes: (a) operating the platform and showing your listing to renters, and (b) promoting and marketing both your listing and SublettingU — including on our website, mobile apps, email, search engines, and social media.

You represent that you own Your Content or have the rights needed to grant this license, that it does not infringe anyone else's rights, and that it does not depict any person who has not consented to appear.

This license lasts while Your Content is on the platform and for a reasonable period afterward to the extent needed to operate and promote the services. When you remove a listing or close your account, we will stop using Your Content in new marketing materials, though copies may remain in materials already published or distributed and in routine backups for a reasonable time. We will never present Your Content in a false or misleading way, and we will not sell it. You may ask us to stop featuring your listing in our marketing at any time by emailing legal@sublettingu.com.

8. Payment Terms

• — SublettingU is completely free for both renters and listers. There are no service fees, booking fees, listing fees, application fees, onboarding fees, or platform commissions. The listing price is exactly what the renter pays, and the lister receives 100% of it.
• — Payment is between the renter and the lister; SublettingU holds no funds and is not the merchant of record. If a listing accepts online payment, the renter's first month's rent and deposit are charged directly to the lister's connected Stripe account (the lister is the merchant of record and absorbs Stripe's processing fee); SublettingU takes 0%. If a listing accepts off-platform payment, the renter and lister settle directly between themselves. Listers who accept online payment must complete Stripe Connect onboarding first.
• — You are solely responsible for all taxes owed on payments you receive.

9. Cancellations and Refunds

Cancellations and refunds are governed by our Cancellation Policy, which is incorporated into these Terms by reference. Refunds are generally issued within 5–10 business days to the original payment method.

10. Sublease Agreement

When a booking is confirmed, SublettingU generates an electronic sublease agreement between the renter and the lister. Both parties must sign electronically before move-in. SublettingU is not a party to the sublease and does not act as a landlord, tenant, or real estate broker. Disputes arising under the sublease are between the renter and lister; SublettingU may, at its discretion, assist with resolution.

11. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or your use of SublettingU shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and SublettingU waive any right to bring or participate in a class action. You may opt out of arbitration within 30 days of creating your account by emailing legal@sublettingu.com. Arbitration shall take place in Wilmington, Delaware unless we mutually agree otherwise.

12. Limitation of Liability

SublettingU is a marketplace technology platform. We do not own, control, manage, or inspect any of the properties listed. To the maximum extent permitted by law, SublettingU and its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or property arising from your use of the platform. Our aggregate liability shall not exceed the greater of (a) the total fees you paid SublettingU in the 12 months preceding the claim or (b) USD $100.

13. Indemnification

You agree to indemnify and hold harmless SublettingU from any claim, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, your conduct, or any sublease agreement you enter into through the platform.

14. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time through your profile settings. Termination does not affect any rights, obligations, or liabilities accrued before termination.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, any judicial proceeding shall be brought in the state or federal courts located in New Castle County, Delaware.

16. Changes

We may revise these Terms from time to time. Material changes take effect when we publish the updated Terms, and we will ask you to review and accept them the next time you use SublettingU. You must accept the revised Terms to continue using the platform; if you do not accept, you may stop using SublettingU and close your account.
