These Terms of Service (“Terms”) form a binding legal agreement between you and SublettingU Inc. (“SublettingU”, “we”, “us”). By creating an account, listing a property, or booking a sublet, you agree to these Terms in full.
You must be at least 18 years of age and legally able to enter into a binding contract. If you list a property, you represent and warrant that you have the legal right to sublet it under your existing lease, governing condominium documents, HOA rules, and applicable law. SublettingU is not responsible for verifying the lawfulness of any individual sublet.
All users must complete identity verification before booking or listing a property. You agree to provide a valid government-issued ID and a verification selfie. Failure to verify, providing false documents, or any attempt to bypass verification is grounds for immediate account termination.
Listers must submit proof that they have the right to sublet — typically a current lease, utility bill, or other official document showing their name and the listed address. SublettingU reviews each submission and reserves the right to approve, reject, or remove a listing at any time.

Cancellations and refunds are governed by our Cancellation Policy, which is incorporated into these Terms by reference. Refunds are generally issued within 5–10 business days to the original payment method.
When a booking is confirmed, SublettingU generates an electronic sublease agreement between the renter and the lister. Both parties must sign electronically before move-in. SublettingU is not a party to the sublease and does not act as a landlord, tenant, or real estate broker. Disputes arising under the sublease are between the renter and lister; SublettingU may, at its discretion, assist with resolution.
Any dispute arising out of or relating to these Terms or your use of SublettingU shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and SublettingU waive any right to bring or participate in a class action. You may opt out of arbitration within 30 days of creating your account by emailing legal@sublettingu.com. Arbitration shall take place in Wilmington, Delaware unless we mutually agree otherwise.
SublettingU is a marketplace technology platform. We do not own, control, manage, or inspect any of the properties listed. To the maximum extent permitted by law, SublettingU and its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or property arising from your use of the platform. Our aggregate liability shall not exceed the greater of (a) the total fees you paid SublettingU in the 12 months preceding the claim or (b) USD $100.
You agree to indemnify and hold harmless SublettingU from any claim, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, your conduct, or any sublease agreement you enter into through the platform.
We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may close your account at any time through your profile settings. Termination does not affect any rights, obligations, or liabilities accrued before termination.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, any judicial proceeding shall be brought in the state or federal courts located in New Castle County, Delaware.
We may revise these Terms from time to time. Material changes will be announced by email and through the platform at least 14 days before they take effect. Continued use of SublettingU after that period constitutes acceptance of the revised Terms.
