Student Subletting Agreement Checklist

A handshake deal or a DM agreement is not sufficient for a sublet — even between students. A written sublease agreement protects both the lister and the tenant, and it's the only document that can resolve a dispute over a security deposit or property damage. A single well-structured page is enough.
The required elements
Every sublease agreement must include:
- Full legal names of both the lister (sublessor) and tenant (sublessee)
- Property address and unit number
- Exact lease start and end dates
- Monthly rent amount and due date
- Security deposit amount and return conditions
- Contact information for both parties
- Signatures and date
Furnishing and condition
If the sublet is furnished, attach an inventory list. This prevents disputes about what was present and in what condition when the tenant arrived.
- List all furniture and appliances included by room
- Note any existing damage for major items (scratch on desk, stain on couch)
- Reference the move-in condition photos as part of the agreement
Do this regardless:Take timestamped photos of every room before the tenant's move-in date and share them with the tenant in writing. Both parties should acknowledge receipt. This documentation is what wins deposit disputes.
Utilities and services
- List which utilities are included in rent (electric, gas, water, WiFi, trash)
- Specify any caps (e.g., "electric usage above $75/month billed to tenant")
- Clarify how internet service will be handled — transferred, shared account, or tenant sets up their own
Rules and restrictions
- Smoking policy (inside the unit and on any outdoor space)
- Pet policy (types, sizes, breed restrictions from the master lease)
- Overnight guest limit or policy (check your master lease — many have limits)
- Noise/quiet hours if the building has rules
- Subletting restrictions — the tenant may not further sublet the unit
Security deposit terms
Specify the deposit amount, the account it will be held in, the timeline for return after move-out, and the conditions for any deductions. State law governs the maximum deposit and return timeline — look up your state's rules and reference them in the agreement. Most states require return within 14–30 days of move-out with an itemized deduction statement.

- Move-out date and time (be precise — not just a date)
- Required apartment condition for full deposit return (clean, no damage beyond normal wear)
- Key return process
- Deposit return timeline and method (Venmo, check, Zelle)
